I move we establish a committee for the purpose of looking into the feasibility of establishing an SBCA ethics committee that would give members and potential members a way to address grievances.

Arbitration Committee

Duties and Responsibilities


The Arbitration Committee Chair position requires a wide familiarity with prevailing standards or ethics for transactions in Newfoundland dogs. Position involves extensive, often very lengthy correspondence on delicate, intricate matters. As emotional involvement of parties to complaints is often very high, and as the Arbitration Committee often represents NCA to unhappy members, caution, tact and integrity are essential.
The Arbitration Committee Chair:
• Receives complaints against NCA members from NCA members and non-NCA members concerning Newfoundland dog transactions such as puppy sales, co-ownership agreements, etc.
• Screens complaints as to appropriateness.
• Mediates, disputes, or assigns a Committee member to do so, with the aim of resolution at the most informal level possible.
• When necessary, invites all parties to submit evidence and arguments concerning disputes and renders a decision. Exerts moral persuasion as appropriate toward carrying out of the decision.
• Educates NCA members and non-members as to the importance of clearly written contracts.
• Consults with NCA President and other officers as necessary. Advises NCA Board as to policy.
• Advises all parties of NCA policy regarding resolution of disputes. Advises parties of committee's recommendations if they cannot, with help, resolve their dispute. Advise parties of their right to come before the Board if they do not accept the committee’s recommendations. Recommend appropriate
sanctions by Board if recommendations are ignored.

History & Board Actions

V21.4 11/10/90: Grievance Committee renamed Arbitration Committee and job description is to be revised accordingly. [See additional history and procedures under (former) Grievance Committee.]
V28.2 12/23/96 (Mail Meeting): NCA Disciplinary Hearing Procedures approved by the Board. (See related section -- Disciplinary Hearing Procedures in Volume II of the NCA Policies and Procedures.)
V32.1 11/3/00: Policy created to deal with disposition of past grievance materials and the maintenance of a list of grievances and their dispositions. The list to include
names of complainants and defendents, pertinent dates, brief description of complain and disposition.. The materials will be kept for seven (7) years and a list will be maintained by the President. (add to President job description).
V32.3 4/2/01: Develop policy to clarify difference between arbitration process and grievance process and the grievance procedure for its consideration.
11/4/05: Any email that comes to any Board member with a complaint against an NCA member, be emailed directly to the Arbitration Committee and the other Board members
will not be notified.
1/6/06: Amend a previous motion that was approved at the November 4-6, 2005 meeting by changing “member” to “breeder”. That previously approved motion read,
“Mary Lou Roberts moved and Sandee Lovett seconded that, in the future, any email that comes to any Board member with a complaint against an NCA member, be forwarded directly to the Arbitration Committee and the other Board
members will not be notified."

AKC MEDALLIONS FOR LONG BEACH SHOW

AkC has asked all parent clubs to donate the medallions that are given to the exhibitors winning Best of Breed, Best of Opposite Sex and Best in Bred By Exhibitor at its show in Long Beach, California in December, 2008.

Given the anti-dog legislation that has been proposed in California, many fanciers have asked AKC to move the show from California.  Unfortunately, this is not easily done because of requirements of such a huge event.  Among the requirements:  the location must be in one of the 5 major television markets; the size of the exhibition hall must be at least 350,000 sq. feet; there must be an international airport serving the area.   

Should the SBCA donate the above medallions?

Pro: The medallions should be donated by the SBCA to show the club’s support of the winners of the event.  Not awarding them does not hurt AKC, it penalizes the winners who would not receive this additional memento of their win.

Con: In light of California’s anti-dog legislation, the SBCA should show its opposition to the California site by not donating the medallions.  The winners will still receive trophies and cash awards from AKC.

Motion:
I move that we accept the following recommendations put forth by a committee consisting of Horst Vogel, Vicki Graves and Ivan Palmblad, regarding new title photos and pedigrees placed in the Saint Fancier and Annual:

The following are the recommendations unanimously agreed upon by
this committee.

  1. ALL title holders (AKC, SBCA, Canadian Kennel Club & Foreign)
    will get their picture/pedigree published in the Fancier (no limit) as before. (no other registry will be recognized, example UKC)
    2. HOF, PE are to receive the same honor.
    3. No title holder will be published more than once in any given Fancier for free.
    4. Stud Dog and Brood bitch of the year will be recognized the same way. (pic/ped Ch. Get listed) in the Fancier which highlights the National show each year.**
    5. Give recognition to the winner of the Breeders trophy in same
    issue. (picture & short blurb)
    6. No dog appears more than once in any annual, no matter how many titles he has earned during that year---after the first title for that year the other titles will be listed on the page with only 1 picture and pedigree. Said dog may however be published in the following year's annual if he obtained additional titles during that calendar year.

Should a St. Bernard achieve a title as well as Stud Dog or Brood Bitch they are to get 2 separate pix/ped in the Fancier and instead of show wins the Ch. get will be listed.

"MOVE that in an effort to solve late renewal issues, lapsed memberships and the resulting problems, the following membership renewal procedures will be added to the job duties of the Member Records Chair and the Treasurer:

1.  The Member Records Chair will place a notice in the last Fancier of the calendar year to remind everyone that all members, including international, will be receiving their dues reminder by postal mail in the month of December and that if he/she has not received it within a reasonable length of time, to please contact the Member Records Chair.

2.  The Member Records Chair will place a notice in the first edition of the Fancier for the year stating that this may be the member's last Fancier if his/her  renewal has not been received by March 1st.

3.  By March 15th, the Treasurer will provide the Member Records Chair AND the entire Board with a list of all those who have NOT renewed.  In addition a notice with this list will be sent by the Member Records Chair to the Editor for publication in the next available Fancier.

4.  By April 1st, the Member Records Chair will send a second notice (letter, postcard or email) to all those who have not renewed, reminding them of the 60 day grace period allowed per the Constitution in which to renew.

5.  As soon as possible after the 60 day grace period deadline, the Treasurer again will provide the Member Records Chair and the entire Board with a list of those who have not renewed, and will remove their names from the files.

6.  Per the Constitution and Bylaws (Article 1,  Section 4b) the Treasurer will bring any meritorious case as received from any lapsed member during the next 90 days to the entire Board for review."
